Article 79R&D procurement excluded
This Regulation does not apply to procurement for public contracts exclusively containing research and development services as defined in Article 6, point (16). The first sentence does not apply to procurement for public contracts containing, in addition to research and development services as defined in Article 6, point (16), other elements falling within the scope of this Regulation, in particular where testing and validation is part of the innovation procedure pursuant to Title I, Chapter 4 of this Part, or where research and development is integrated as an innovation technique in public procurement falling within the scope of this Regulation pursuant to Article 61.
