Artykuł 90Związek z przedmiotem zamówienia
Article 90 · Link to the subject-matter
1.Selection criteria, award criteria, specifications, and the conditions for the performance of contracts shall be linked to the subject-matter of the contract. Such a link shall be considered to subsist where the condition, requirement or criterion in question relates to the works, supplies or services to be provided under the contract at any stage of their life-cycle.
1.Kryteria kwalifikacji, kryteria udzielenia zamówienia, specyfikacje i warunki realizacji umowy muszą być związane z przedmiotem zamówienia. Uznaje się, że taki związek istnieje, w przypadku gdy dany warunek, wymaganie lub kryterium odnosi się do robót budowlanych, dostaw lub usług, które mają być realizowane w ramach zamówienia, na którymkolwiek etapie ich cyklu życia.
2.The link to the subject-matter may be either direct, that is to say the condition, requirement or criterion in question is intrinsically related to the material substance of the subject-matter of the contract, or indirect.
2.Związek z przedmiotem zamówienia może być bezpośredni, to znaczy dany warunek, wymaganie lub kryterium jest nieodłącznie związane z materialną istotą przedmiotu zamówienia, lub pośredni.
3.A condition, requirement or criterion shall be considered to be indirectly linked to the subject-matter of the contract, where, without being part of the material substance of the works, services or supplies in question, it specifically impacts those works, services or supplies as regards their preparation, production or any other stage of their life-cycle to the extent covered by the contract, including the working conditions of the workers involved in any of those stages of the life-cycle and responsible sourcing and supply chain transparency for the product subject to the procurement in question.
3.Uznaje się, że warunek, wymaganie lub kryterium jest pośrednio związane z przedmiotem zamówienia, w przypadku gdy, nie stanowiąc części materialnej istoty danych robót budowlanych, usług lub dostaw, w szczególny sposób wpływa na te roboty budowlane, usługi lub dostawy w zakresie ich przygotowania, produkcji lub jakiegokolwiek innego etapu ich cyklu życia w zakresie objętym zamówieniem, w tym na warunki pracy pracowników zaangażowanych na którymkolwiek z tych etapów cyklu życia oraz na odpowiedzialne pozyskiwanie i przejrzystość łańcucha dostaw w odniesieniu do produktu będącego przedmiotem danego zamówienia.
