Article 107 · Termination of contracts
Without prejudice to any other grounds for termination provided for in this Act or under applicable national law, public buyers shall terminate the contract where:
Sem prejuízo de quaisquer outros fundamentos de rescisão previstos no presente ato ou no direito nacional aplicável, os compradores públicos rescindem o contrato caso:
(a)the economic operator becomes subject of a final conviction for one of the grounds referred to in Article 25, except where the public buyer establishes that such termination is not warranted for reasons of overriding public interest and the final judgment does not preclude this;
(a)O operador económico seja objeto de uma condenação definitiva por um dos motivos referidos no artigo 25.º, exceto se o comprador público determinar que essa rescisão não se justifica por razões imperativas de interesse público e a sentença definitiva não o impedir;
(b)the contract or its modification should not have been awarded to the contractor in view of a serious infringement of the obligations under the Treaties and this Regulation that has been declared by the Court of Justice of the European Union in a procedure pursuant to Article 258 of the Treaty.
(b)O contrato ou a sua modificação não devesse ter sido adjudicado ao adjudicatário em virtude de um incumprimento grave das obrigações decorrentes dos Tratados e do presente regulamento declarado pelo Tribunal de Justiça da União Europeia num processo nos termos do artigo 258.º do Tratado.
