Artikel 130Gemeinsame Spezifikationen
Article 130 · Common specifications
1.The Commission may adopt implementing acts establishing common specifications as referred to in Article 88(4), point (a), covering the essential requirements for the semantic data model of the core elements of the procurement procedures referred to in Article 129(1), point (a). Those implementing acts may be adopted where the Commission has requested, pursuant to Article 10(1) of Regulation (EU) No 1025/2012, one or more European standardisation organisations to draft or to revise European standards for those requirements and:
1.Die Kommission kann Durchführungsrechtsakte zur Festlegung gemeinsamer Spezifikationen gemäß Artikel 88 Absatz 4 Buchstabe a erlassen, die die grundlegenden Anforderungen an das semantische Datenmodell der Kernelemente der in Artikel 129 Absatz 1 Buchstabe a genannten Vergabeverfahren abdecken. Diese Durchführungsrechtsakte können erlassen werden, wenn die Kommission gemäß Artikel 10 Absatz 1 der Verordnung (EU) Nr. 1025/2012 eine oder mehrere europäische Normungsorganisationen damit beauftragt hat, europäische Normen für diese Anforderungen auszuarbeiten oder zu überarbeiten, und
(a)the request has not been accepted by any of the European standardisation organisations to which the request was addressed; or
(a)der Auftrag von keiner der europäischen Normungsorganisationen, an die er gerichtet war, angenommen wurde oder
(b)the request has been accepted by at least one of the European standardisation organisations to which the request was addressed, but the European standards requested:
(b)der Auftrag von mindestens einer der europäischen Normungsorganisationen, an die er gerichtet war, angenommen wurde, die angeforderten europäischen Normen jedoch
(i)are not delivered within the deadline set in the request;
(i)nicht innerhalb der in dem Auftrag festgelegten Frist vorgelegt werden;
(ii)do not comply with the request; or
(ii)dem Auftrag nicht entsprechen oder
(iii)do not satisfy the requirements they aim to cover.
(iii)die Anforderungen, die sie abdecken sollen, nicht erfüllen.
2.Where the references of a harmonised standard are published in the Official Journal of the European Union, the Commission shall repeal the implementing acts adopted pursuant to paragraph 1, or the relevant parts thereof, to the extent they cover the same requirements.
2.Werden die Fundstellen einer harmonisierten Norm im Amtsblatt der Europäischen Union veröffentlicht, so hebt die Kommission die gemäß Absatz 1 erlassenen Durchführungsrechtsakte oder die betreffenden Teile davon auf, soweit sie dieselben Anforderungen abdecken.
3.When a Member State or the European Parliament considers that a common specification or parts thereof do not entirely satisfy the requirements which it covers, it shall inform the Commission thereof by submitting a detailed explanation. The Commission shall assess that detailed explanation and may, if appropriate, amend the implementing act establishing the common specification in question.
3.Ist ein Mitgliedstaat oder das Europäische Parlament der Auffassung, dass eine gemeinsame Spezifikation oder Teile davon den Anforderungen, die sie abdeckt, nicht vollständig entsprechen, so unterrichtet er bzw. es die Kommission unter Vorlage einer ausführlichen Erläuterung davon. Die Kommission prüft diese ausführliche Erläuterung und kann gegebenenfalls den Durchführungsrechtsakt zur Festlegung der betreffenden gemeinsamen Spezifikation ändern.
