Article 35 · Finalisation of the procedure and award of the contract

1.Public buyers shall award the contract to the tenderer or tenderers that have submitted the tender offering the best quality for money in accordance with Article 98.

1.Gli acquirenti pubblici aggiudicano il contratto all’offerente o agli offerenti che hanno presentato l’offerta con la migliore qualità in rapporto alla spesa, conformemente all’articolo 98.

2.Without prejudice to the standstill period established in Directives 89/665/EEC and 92/13/EEC, the contract shall be concluded in accordance with the applicable law of the Member State of the public buyer.

2.Fatto salvo il termine sospensivo previsto dalle direttive 89/665/CEE e 92/13/CEE, il contratto è stipulato conformemente al diritto applicabile dello Stato membro dell’acquirente pubblico.
