Article 48 · Emergency and crisis

1.Public buyers may make use of the procedure described in Article 46, where, for reasons of extreme urgency not attributable to the public buyer, the time limits for the procedures in this Regulation cannot be complied with.

1.Gli acquirenti pubblici possono ricorrere alla procedura di cui all’articolo 46 qualora, per ragioni di estrema urgenza non imputabili all’acquirente pubblico, non sia possibile rispettare i termini delle procedure previste dal presente regolamento.

2.Without prejudice to any joint procurement activities organised by the Union institutions, bodies, offices and agencies where an emergency mode has been activated pursuant Regulation (EU) 2024/2747, the emergency framework has been activated pursuant Council Regulation (EU) 2022/2372, serious cross-border threats to health pursuant to Regulation (EU) 2022/2371 exist, or the Commission has declared a crisis or a state of emergency, the condition set out in paragraph 1 shall be deemed to be fulfilled for the type of solutions concerned and for as long as the state of emergency or the serious cross-border threat exist.

2.Fatte salve le attività di appalto congiunto organizzate dalle istituzioni, dagli organi e dagli organismi dell’Unione, qualora sia stata attivata la modalità di emergenza a norma del regolamento (UE) 2024/2747, sia stato attivato il quadro di emergenza a norma del regolamento (UE) 2022/2372 del Consiglio, sussistano gravi minacce per la salute a carattere transfrontaliero a norma del regolamento (UE) 2022/2371 o la Commissione abbia dichiarato una crisi o uno stato di emergenza, la condizione di cui al paragrafo 1 si considera soddisfatta per il tipo di soluzioni interessate e finché perdurano lo stato di emergenza o la grave minaccia a carattere transfrontaliero.
